Terms & Conditions (Digital PDF Downloads)

These Terms & Conditions (“Terms”) apply to all digital products (including PDF downloads) sold by Hope Valley Equestrian (“we”, “us”, “our”). By purchasing or downloading any digital product from us, you agree to these Terms.
If you do not agree, please do not purchase or download our products.
1. Digital products
Our products are delivered digitally (for example, as PDF files). No physical items are shipped.
After successful payment, you will receive:
- a confirmation / “Thank You” message, and
- an email containing your access instructions and download link (or access via your customer account area, if available).
2. Licence to use (personal / single business use)
Unless otherwise stated on the product page, your purchase grants you a non-exclusive, non-transferable licence to download and use the digital product for:
- your own personal use; or
- your own business use within your single riding school/business (e.g., internal curriculum, lesson planning, progress tracking).
You may print copies for your own use and keep digital copies on your own devices.
You must not:
- share, forward, resell, redistribute, upload, or provide the file to others (free or paid);
- publish the content online (including on websites, forums, file-sharing services, social media, or AI training datasets);
- modify and resell or claim the content as your own;
- use the content as part of a competing product or service for sale.
If you need a broader licence (e.g., multi-location use, multiple trainers across separate businesses, or reselling rights), contact us before purchasing.
3. Intellectual property
All digital products and content are owned by us (or licensed to us) and are protected by copyright and other intellectual property laws.
Purchasing a product does not transfer ownership of the content. You are buying a licence to use the content under these Terms.
4. Pricing & payments
All prices are shown in AUD unless stated otherwise.
Payments are processed securely via third-party payment providers such as Stripe and/or PayPal. We do not store your full payment details.
Your purchase may be subject to the payment provider’s own terms and policies.
5. Delivery, access & download limits
Because these are digital files, delivery is typically instant (or within a short time after payment is confirmed).
For security, download links may:
- expire after a set period,
- have a limited number of download attempts, and/or
- require access through your account login.
If you do not receive your email within a reasonable time, please check your spam/junk folder first, then contact us.
6. Refunds & change of mind
Due to the nature of digital products (instant access/download), change-of-mind refunds are generally not available.
However, we will consider a refund or replacement in situations such as:
- you were charged multiple times for the same purchase;
- the file is corrupted or unusable and we cannot provide a working replacement;
- you purchased the wrong item due to a clear error on our product page.
If you believe you are eligible, contact us within 7 days of purchase with your order details and a brief explanation.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
7. Educational information only (no professional advice)
Our PDFs are provided for general educational and informational purposes only.
They are not a substitute for professional advice, including (without limitation) veterinary, medical, financial, legal, or qualified coaching instruction. You are responsible for how you use the information.
8. Assumption of risk (equestrian activities)
Horse-related activities carry inherent risk, including the risk of injury, illness, property damage, and in rare cases serious harm.
To the fullest extent permitted by law:
- you acknowledge these risks, and
- you agree that you use our content at your own discretion and responsibility.
You should always act within your abilities and the abilities of your horse, use appropriate protective gear (including an approved riding helmet), ensure appropriate supervision, and seek professional help where needed.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any loss, injury, claim, damage, or expense (including indirect or consequential loss) arising from or connected with:
- your purchase, download, or use of any digital product;
- actions you take based on the content;
- your inability to access or download a file due to factors outside our control (such as email delivery issues, device/software incompatibility, or network outages).
Where liability cannot be excluded under applicable law, our liability is limited (at our option) to:
- replacing the product, or
- refunding the amount paid for the product.
10. Compatibility & your responsibilities
You are responsible for ensuring:
- you have a device and software capable of opening PDF files;
- you enter a valid email address at checkout;
- you download and store a copy of the file for your records.
11. Prohibited use
You must not use our site or products:
- in any way that breaches any law or regulation;
- to infringe intellectual property rights;
- to distribute malware, spam, or malicious content;
- to harass, abuse, defame, or harm others.
12. Updates to products
We may occasionally update or improve a digital product. Unless stated otherwise, purchasing does not guarantee access to future updates, bonuses, or revised editions.
13. Privacy
We handle personal information in accordance with our Privacy Policy (if available on our site). At a minimum, we collect the information required to process your purchase and deliver your digital product.
14. Governing law
These Terms are governed by the laws of Australia. You submit to the jurisdiction of the courts in the relevant Australian state/territory.
